These Terms of Service ("Terms") govern your use of MusicStudio.com and the services available through it (the "Platform").
The Platform is operated by Luteic Limited, trading as MusicStudio ("MusicStudio", "we", "us" or "our").
By creating an account, making a booking or otherwise using the Platform, you agree to these Terms. Please read them before booking a lesson.
1.1 MusicStudio is an online marketplace connecting independent music teachers ("Teachers") with students and their parents or guardians ("Students").
1.2 MusicStudio provides technology and services to help users find Teachers, communicate, book lessons, make payments and participate in online lessons. MusicStudio does not itself provide music tuition.
1.3 Each Teacher is an independent provider responsible for their own tuition, qualifications, professional conduct and legal obligations. Teachers are not employees of MusicStudio.
1.4 The contract for a music lesson is between the Student (or the adult making the booking) and the Teacher. MusicStudio acts as the Teacher's disclosed agent for arranging bookings, collecting lesson payments and administering the agreed booking terms.
1.5 MusicStudio may assist with complaints, cancellations and refunds, but doing so does not make MusicStudio the supplier of the tuition or remove any responsibility it has under applicable law for its own services.
2.1 You must be at least 18 years old to create an account, book lessons or register as a Teacher.
2.2 A parent or legal guardian may book lessons for a child under 18 and is responsible for supervising the child's use of the Platform and ensuring compliance with these Terms.
2.3 You must provide accurate information, keep your account details secure and notify us promptly of suspected unauthorised access.
2.4 Accounts are personal and must not be transferred or shared without our permission.
2.5 We may refuse registration or restrict an account where reasonably necessary for safety, security, fraud prevention, legal compliance or protection of other users.
3.1 Teachers are independent professionals who determine their lesson content, teaching methods, availability and standard lesson prices.
3.2 MusicStudio manually reviews Teacher profiles before publication, including profile information and introductory videos.
3.3 This review is not a comprehensive background investigation, professional accreditation or guarantee of teaching quality, qualifications, experience or suitability.
3.4 MusicStudio does not guarantee that a Teacher will be suitable for a particular Student or that lessons will produce any particular result, including examination success, qualifications or musical progress.
3.5 Students and parents should review a Teacher's profile, ask appropriate questions and make their own assessment of suitability before booking.
3.6 We may request additional information, restrict a profile or remove a Teacher from the Platform where we reasonably consider this necessary.
4.1 Teachers set their standard lesson prices.
4.2 Lessons are offered in two durations:
MusicStudio may offer introductory lessons, discounts and other promotional pricing at its discretion. Eligibility, pricing and any applicable conditions will be displayed before booking. MusicStudio may fund discounts from its own funds without reducing the Teacher's agreed payment. Promotional offers may be changed or withdrawn at any time, but changes will not affect confirmed bookings.
4.4 Prices and applicable charges are displayed before payment. A booking is confirmed when the Platform confirms acceptance and successful payment.
4.5 MusicStudio uses Stripe to process payments and collect money on behalf of Teachers. MusicStudio deducts its applicable fees from the amounts collected.
Where you choose to pay in a currency other than that of the teacher, MusicStudio may apply an additional currency conversion fee. Any applicable fee will be included in the total price and disclosed before you confirm your booking.
4.7 Currency conversion rates may vary. Your bank or card provider may apply additional charges outside MusicStudio's control.
4.8 Any refund will include the corresponding refundable portion of MusicStudio's cross-currency charge. Where a payment was converted between currencies, the amount received in your local currency may differ because of exchange-rate movements or third-party charges.
4.9 We may correct obvious pricing or technical errors before a booking is confirmed. We will not increase the agreed price of an existing confirmed booking without your consent.
5.1 You may cancel a lesson through the Platform. The following standard cancellation policy applies:
5.2 The applicable cancellation time is calculated using the scheduled lesson start time recorded by the Platform.
5.3 Where a Teacher cancels or fails to attend, you are entitled to a full refund or, if you prefer, a rearranged lesson.
5.4 Where a failure of the MusicStudio Platform prevents a lesson from taking place, you may choose a full refund or a rearranged lesson.
5.5 Where a lesson is materially shortened or interrupted, MusicStudio may review the circumstances and arrange a proportionate refund, replacement lesson or other appropriate remedy. This does not limit your statutory rights.
5.6 Where a Student fails to attend, the standard cancellation policy applies.
5.7 Where neither the Student nor the Teacher attends, MusicStudio may attempt to arrange a replacement lesson. If rearrangement is unsuccessful, MusicStudio may retain a reasonable administration charge of up to €20 plus applicable VAT, capped at the total amount paid for that lesson. Any remaining amount will be refunded, and no teaching fee will be paid to the Teacher. This charge applies only where it is lawful, proportionate, and was clearly disclosed before booking.
5.8 Refunds for card payments are returned to the original payment method. Credit originally used for a booking is restored as credit. At your request, we may instead issue eligible card refunds as MusicStudio credit.
5.9 We may investigate suspected fraud, duplicate claims, payment reversals or misuse of refund procedures. We may temporarily restrict related account activity while investigating, but will not withhold refunds to which you are legally entitled.
5.10 Nothing in this section removes your statutory rights where services are not supplied, are defective or are not provided as agreed.
6.1 Certain leisure services booked for a specific date or period are exempt from the statutory 14-day withdrawal right under section 111(q)(v) of the Irish Consumer Rights Act 2022.
6.2 Where a booked music lesson qualifies for this exemption, the statutory 14-day withdrawal right does not apply and the cancellation arrangements in section 5 govern ordinary changes of mind.
6.3 Where the exemption does not apply, any mandatory statutory withdrawal rights remain available. We will provide any information and withdrawal arrangements required by applicable law.
6.4 These Terms do not exclude statutory remedies where a Teacher or MusicStudio fails to fulfil its legal obligations.
7.1 Unused gift vouchers may be cancelled within 14 days of purchase for a full refund, subject to applicable law.
7.2 Purchased account credit, including gift-voucher balances, does not expire.
7.3 Promotional credit provided free of charge, including referral rewards, expires 90 days after issue unless otherwise stated when awarded.
7.4 Available account credit is automatically applied at checkout.
7.5 Account credit cannot ordinarily be exchanged for cash, except where required by law or expressly permitted by MusicStudio.
7.6 We may cancel promotional credit obtained through fraud, duplicate accounts or abuse of a promotion.
8.1 Lessons are delivered through the MusicStudio online video platform. Users are responsible for having suitable equipment, a compatible browser and a reasonably reliable internet connection.
8.2 MusicStudio uses third-party technology providers and cannot guarantee uninterrupted or error-free access.
8.3 Video calls, including lessons, may be recorded in accordance with the information and confirmation presented before joining. Where recording requires consent, the recording will not proceed without the required consent.
8.4 Lesson recordings are normally available to the Student for 30 days and are then automatically deleted in accordance with our Privacy Policy, subject to any lawful retention exception explained there.
8.5 Users must not make, distribute or publish their own recordings, screenshots or other reproductions of a lesson without appropriate permission and a lawful basis.
8.6 Users must respect the privacy, copyright and other rights of everyone participating in a lesson.
9.1 MusicStudio permits parents and guardians to arrange lessons for children under 18.
9.2 Teachers are responsible for complying with applicable child-protection laws and obtaining any required safeguarding clearances, permissions or certifications.
9.3 MusicStudio requires Teachers to declare their compliance with applicable safeguarding requirements. MusicStudio does not independently obtain, inspect or verify Garda vetting disclosures, DBS certificates or equivalent clearance documents.
9.4 Parents and guardians should request and check appropriate evidence directly with the Teacher before allowing a child to participate. MusicStudio's review of a Teacher's identity or profile is not a safeguarding clearance.
9.5 A parent or guardian must be present in the room during a child's first lesson with a new Teacher and remain nearby and within earshot during subsequent lessons.
9.6 Teachers must not solicit private contact with children, request inappropriate personal information or move lessons or communications to private channels outside MusicStudio, except where expressly authorised by MusicStudio and lawful.
9.7 MusicStudio prohibits harassment, grooming, exploitation, sexual misconduct, threatening behaviour and other inappropriate conduct.
9.8 We may immediately suspend accounts, restrict communications, preserve relevant evidence where lawful and report concerns to competent authorities where appropriate.
9.9 Safeguarding concerns should be reported through our safeguarding reporting page. We prioritise these reports and aim to acknowledge them within 24 hours.
9.10 If a child is in immediate danger, contact the appropriate emergency services. In Ireland, call 999 or 112. MusicStudio is not an emergency service.
9.11 Nothing in this section excludes or reduces any safeguarding duty imposed on MusicStudio by law.
10.1 MusicStudio is provided on an "as available" basis. We aim to provide a reliable service but do not guarantee uninterrupted access or the availability of any particular feature.
10.2 Service interruptions may result from maintenance, internet connectivity, user equipment, third-party providers, security incidents or other circumstances.
10.3 Where a lesson fails or is disrupted, we may consider relevant connection records, platform activity, communications and other reasonably available evidence.
10.4 We may request information from the Student and Teacher to help establish what occurred.
10.5 Where a lesson cannot take place because of a MusicStudio technical failure, the Student may choose a refund or rearranged lesson. Teacher compensation, if any, is governed by the separate Teacher Agreement.
10.6 MusicStudio is not responsible for technical problems caused solely by a user's equipment, browser or internet connection, except to the extent required by applicable law.
10.7 We may suspend or restrict access for maintenance, security or operational reasons. We will take reasonable steps to minimise disruption.
11.1 You must use the Platform lawfully and treat other users respectfully.
11.2 You must not:
11.3 Lessons introduced and arranged through MusicStudio must be booked and paid for through MusicStudio while the Teacher and Student use the Platform for that teaching relationship. Users must not deliberately bypass the Platform to avoid applicable fees.
11.4 This restriction does not prevent a user from independently obtaining services outside MusicStudio where no Platform introduction or booking relationship is being circumvented.
11.5 We may investigate suspected breaches and take proportionate action, including removing content, restricting bookings or suspending accounts.
12.1 MusicStudio owns or licenses the Platform's software, branding, design and other proprietary materials.
12.2 Users retain ownership of content they lawfully create and upload.
12.3 By submitting profile information, photographs, introductory videos, reviews or other content for publication, you grant MusicStudio a non-exclusive, royalty-free licence to host, reproduce, display and use that content as reasonably necessary to operate, maintain and promote the Platform.
12.4 You confirm that you have the necessary rights and permissions for content you upload.
12.5 MusicStudio may remove content that breaches these Terms, infringes rights or presents legal or safety risks.
12.6 Lesson materials remain subject to the rights of their respective owners. Access to a lesson or recording does not transfer ownership of copyright or other intellectual property.
13.1 If you experience a problem with a booking, lesson, payment or another user, please contact MusicStudio promptly.
13.2 We may review relevant booking information, communications, connection records and other evidence when considering a complaint.
13.3 MusicStudio may facilitate refunds, rescheduling and other reasonable resolutions on behalf of Teachers, subject to these Terms, the Teacher Agreement and applicable law.
13.4 We aim to resolve complaints fairly and within a reasonable time, but cannot guarantee a particular outcome or response deadline.
13.5 If you disagree with a decision, you may ask us to review it and provide additional relevant information.
13.6 MusicStudio may decline repeated, abusive or clearly unfounded complaints, without restricting statutory consumer rights or safeguarding reports.
14.1 You may stop using MusicStudio and request account closure at any time, subject to outstanding bookings, payment obligations and lawful data-retention requirements.
14.2 We may suspend, restrict or terminate an account where reasonably necessary because of:
14.3 Where appropriate, we will explain the reason for our decision and provide an opportunity to respond. We may act without advance notice where urgent action is reasonably necessary.
14.4 Account closure does not automatically cancel existing payment obligations or remove rights relating to completed transactions.
14.5 Any unused purchased credit or outstanding bookings will be handled in accordance with applicable law and these Terms.
15.1 MusicStudio is responsible for providing its own Platform services with the care and skill required by applicable law.
15.2 Teachers are independent suppliers and are responsible for the tuition they provide, including their teaching methods, professional conduct, qualifications and compliance with applicable laws.
15.3 To the extent permitted by law, MusicStudio is not responsible for a Teacher's independent acts or omissions, lesson quality, teaching outcomes or inaccurate information supplied by a Teacher, except where the loss results from MusicStudio's own breach of duty or legal responsibility.
15.4 MusicStudio does not guarantee that the Platform will be uninterrupted, error-free or suitable for every user's requirements.
15.5 To the maximum extent permitted by applicable law, MusicStudio's aggregate liability for claims arising from its Platform services is limited to the total amount paid by the claimant through MusicStudio during the 12 months preceding the event giving rise to the claim. This limit does not apply where it would be unlawful or unfair to impose it.
15.6 Nothing in these Terms excludes or restricts liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited.
15.7 Nothing in these Terms excludes or restricts a consumer's mandatory statutory rights or remedies.
15.8 Where you use the Platform in the course of a business, MusicStudio is not liable for indirect or consequential business losses, loss of profits, loss of opportunity or loss of anticipated savings, to the extent permitted by law.
16.1 We may improve, modify, suspend or discontinue Platform features from time to time.
16.2 We may update these Terms to reflect legal requirements, security needs, changes to our services or other legitimate business reasons.
16.3 We will provide reasonable notice of material changes where required by law, including by email or through the Platform.
16.4 Changes will not retrospectively alter the agreed price or ordinary cancellation terms of a confirmed booking without an applicable legal basis or your agreement.
16.5 If you do not accept revised Terms, you may stop using the Platform and request account closure, subject to any existing lawful obligations.
17.1 If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
17.2 A delay or failure by MusicStudio to enforce a provision does not automatically waive its right to enforce that provision later.
17.3 MusicStudio may use third-party service providers to operate the Platform, subject to applicable legal obligations.
17.4 These Terms, together with the booking details and any additional terms expressly accepted at checkout, set out the agreement governing your use of the Platform. The separate Teacher Agreement applies to Teachers.
17.5 Nothing in these Terms prevents a consumer from relying on statements, information or rights that cannot lawfully be excluded.
18.1 These Terms are governed by Irish law.
18.2 If you are a consumer, this choice does not deprive you of mandatory protections under the law of the country where you habitually reside.
18.3 Consumers may bring proceedings in any court permitted by applicable consumer jurisdiction rules. MusicStudio will bring proceedings against consumers only in courts permitted by those rules.
18.4 Where you are acting in the course of a business, the courts of Ireland have exclusive jurisdiction, subject to applicable mandatory law.
18.5 Nothing prevents either party from seeking urgent relief from a court with appropriate jurisdiction.
